REGULAR MEETING

DECEMBER 1, 2014

The regular monthly meeting of the Jefferson Township Board of Supervisors was held on Monday, December 1, 2014 at 7:30 p.m. in the Jefferson Township Municipal Bldg., 487 Cortez Rd., Jefferson Township, PA 18436.

Call to Order: Meeting was called to order at 7:30 p.m. by Chairman Lester L. Butler, Jr.

Roll Call: Lester L. Butler, Jr., John H. Patterson, Jr., Paul T. Thomas, Donald P. Dolan, Coleen Watt was absent.

Public Comment on Agenda Items: None

Minutes of Previous Meeting: A motion was made by Paul T. Thomas second by John H. Patterson, Jr. to approve the minutes of the previous meeting. Aye carried.

Treasurers Report: A motion was made by Paul T. Thomas second by John H. Patterson, Jr. to approve the treasurers report as read. Aye carried.

Report of Officials and Committees: A motion was made by Paul T. Thomas second by John H. Patterson, Jr. to approve the reports of officials and committees. Aye carried.

Unfinished Business: A motion was made by John H. Patterson, Jr. second by Paul T. Thomas to resign the Cummings Subdivision. Maps were not recorded in a timely fashion. Aye carried.

Ordinances and Resolutions: Ordinance 2014-1

An ordinance of the Board of Supervisors of the Township of Jefferson, Lackawanna County, Pennsylvania (The "Township"), authorizing and directing the incurrence of lease rental debt in the maximum aggregate principal amount of seven hundred thirty thousand seven hundred on dollars and forty two cents ($730,701.42), pursuant to the act of the General Assembly of th Commonwealth of Pennsylvania, 53 PA.C.S., Chapters 80-82, as amended, known as th Local Government Unit Debt Act as lease rental debt to be evidenced by a guaranty agreement of the Township securing two guaranteed sewer revenue bonds, namely Guaranteed Sewer Revenue Bond, Series A of 2015 and Federally Taxable Guaranteed Sewer Revenue Bond Series B of 2015 (collectively, the "2015 Bonds"), to be executed by the Jefferson Township Sewer Authority (the "Authority) to finance a project for the Authority consisting of all or any of the following: (1) refunding the Authority's outstanding sewer revenue note, Series of 2011; and (2) paying the costs and expenses of financing such project; briefly describing such project for which such debt is to be incurred; authorizing and directing the proper officers of this Township: (A) to prepare, to certify and to file the debt statement and borrowing base certificate required by section 8110 of the Debt Act; (B) to cause to be prepared and filed, statements required by section 8026 of the Debt Act which are necessary to qualify all of such lease rental debt for exclusion from the appropriate debt limit as self liquidating debt, if necessary of desirable; and (C) to execute, to attest, to seal and to deliver a guarantee agreement, among this Township, the Authority and the Purchaser of the 2015 Bonds and to execute, to attest, to seal and to deliver, if necessary or desirable, a reimbursement agreement between the Township and the Authority; approving a report of the Authority's Consultant with regard to the self-liquidating debt; specifying the amount of the Guaranty Obligation of this Township pursuant to such Guaranty agreement and the sources of payment of such guaranty obligation' authorizing the proper officers of this Township to take all other required, necessary or desirable related action in connection with such project ant the execution and delivery of such guaranty agreement' providing for the effectiveness of this ordinance; providing for the severability of provisions of this ordinance; and providing for the repealing of all consistent ordinances or resolutions or parts of ordinances.

A motion was made by John H. Patterson, Jr. second by Paul T. Thomas to adopt Ordinance 2014-1. Aye carried.

Action on Bills: A motion was made by Paul T. Thomas second by John H. Patterson, Jr. to pay all outstanding bills and payroll. Aye carried.

New Business: A motion was made by Paul T. Thomas second by John H. Patterson, Jr. to approve Real Estate Tax Collector, Ceatana Keatings appointment of Mauri B. Kelly of Springbrook Township to serve as Deputy Tax Collector on her behalf for the term December1, 2014 through December 31, 2017. Aye carried.

A motion was made by Paul T. Thomas second by John H. Patterson, Jr. to advertise the 2015 Tentative Budget. Aye carried.

Public Comment: Nancy Utter stated we need experienced people to be placed on the Sewer Authority Board.

Mr. Kapeluck stated we need experienced people on the Sewer Authority. Also asked if Ike Butler would abstained from appointing any family members to the Sewer Authority

Barbara Mehne stated she is not opposed to Supervisors receiving health insurance but if they want family members on the plan, they should pay for them.

Will Keating stated the last person appointed to the Sewer Authority never attended a Sewer Authority or Township meeting. In his opinion there were more qualified applicants that were overlooked.

John Peters commented on the finances of the Sewer Authority.

Paula Sorg asked when the Supervisors plan on doing something about the Sewer Authority and their finances.

There being no further business a motion was made by Paul T. Thomas second by John H. Patterson, Jr. to adjourn the meeting.
