PUBLIC HEARING

NOVEMBER 3, 2014

A public hearing was held at the Jefferson Township Municipal Bldg., 487 Cortez Rd., Jefferson Twp., PA to approve the transfer of a club license from Dickson City to Jefferson Township. The license is being purchased by The Veterans Home Association of Cortez.

Hearing was called to order at 7:00 p.m. by Chairman Lester L. Butler, Jr.

Attorney Donald P. Dolan gave a summary of the transfer which entails moving a Pennsylvania Club Liquor License from the Borough of Dickson City to the Township of Jefferson. Attorney Dolan then asked if anyone in attendance had a objection to the transfer. There were no objections.

RESOLUTION

APPROVING TRANSFER OF A CLUB LICENSE, NO CC-4963, FROM THE BOROUGH OF DICKSON CITY TO THE TOWNSHIP OF JEFFERSON

A Resolution of the Township of Jefferson, County of Lackawanna, Commonwealth of Pennsylvania, approving the transfer of Club Liquor License No. CC-4963 into Township of Jefferson from the Borough of Dickson City.

WHEREAS, Act 141 of 2000 ("the Act") which amends the Commonwealth's Liquor Code, Pennsylvania Liquor Control Board to approve, in certain instances the transfer of restaurant liquor licenses across municipal boundaries within the same County regardless of the quota limitations provided for in 461 of the Liquor Code, is sales of liquor and malt or brewed beverages are legal in the municipality receiving the license; and

WHEREAS, the receiving municipality issues a resolution approving the transfer of the license outside the municipality to inside the municipality; and

WHEREAS, on November 3, 2014, Jefferson Township Supervisors conducted a Public Hearing for the purpose of receiving comments and/or recommendations of interested individuals residing within the municipality with respect to the request transfer.

WHEREAS, an application for transfer filed under the Act must contain a copy of the resolution adopted by the municipality approving the transfer of a club liquor license into the municipality.

NOW, Therefore Be it Resolved, VETERANS HOME ASSOCIATION OF CORTEZ, INC. has requested the approval of the Township Supervisors of the Township of Jefferson for the proposed transfer of Pennsylvania Club Liquor License No. CC-4963 to its facility within the Township of Jefferson with the understanding that said transfer must be approved at a later date by the Pennsylvania Liquor Control Board; and Be it Further Resloved, that the Township Supervisors of the Township of Jefferson finds that the transfer of a club liquor license into the Township of Jefferson by VETERANS HOME ASSOCIATION OF CORTEZ, INC. will not adversely affect the welfare, health, peace and morals of the municipality or its residents.

BE it Further Resolved, that Jefferson Township approves, by adoption of this Resolution, the proposed transfer Pennsylvania Club Liquor License No. CC-4963 to be located at 846 Cortez Road, Jefferson Township, Pennsylvania 18436.

Be it Further Resolved, that the license transfer is subject to approval by the Pennsylvania Liquor Control Board; and

DULY RESOLVED AND ADOPTED, this 3rd day of November 2014, by the Township Supervisors of the Township of Jefferson, Lackawanna County, Pennsylvania, in lawful session duly assembled.

A motion was made by John H. Patterson, Jr. second by Paul T. Thomas to approve the transfer Resolution. Aye carried.

There being no further business a motion was made by John H. Patterson, Jr. second by Paul T. Thomas to adjourn.
